    1. Agreement to Terms

    By accessing or using TekPiq's website and services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our services.

    2. Description of Services

    TekPiq provides software development services, including but not limited to:

    • Custom software development
    • Mobile application development (iOS and Android)
    • Web application development
    • MVP development
    • IT consulting and digital transformation services
    • Quality assurance and testing

    3. Service Agreements

    3.1 Project Scope

    Each project will be governed by a separate written agreement that outlines the specific scope, deliverables, timeline, and pricing. These Terms of Service complement but do not replace project-specific agreements.

    3.2 Changes to Scope

    Any changes to the agreed project scope must be documented and approved by both parties in writing. Additional work beyond the original scope may result in additional fees and timeline adjustments.

    4. Client Responsibilities

    Clients are responsible for:

    • Providing accurate and complete information
    • Timely review and feedback on deliverables
    • Making timely payments as per the agreement
    • Providing necessary access to systems and resources
    • Ensuring they have the right to use all materials provided to us

    5. Payment Terms

    5.1 Pricing

    Project pricing will be outlined in your project agreement. Prices are subject to change for new projects but will remain fixed for ongoing projects unless scope changes are agreed upon.

    5.2 Payment Schedule

    Payment terms will be specified in your project agreement. Typical payment structures include milestone-based payments or monthly retainers.

    5.3 Late Payments

    Late payments may result in project suspension and may incur late fees as specified in your project agreement.

    6. Intellectual Property Rights

    6.1 Client-Owned IP

    Upon full payment, clients receive ownership of custom code and deliverables created specifically for their project, as outlined in the project agreement.

    6.2 Pre-Existing IP

    TekPiq retains ownership of pre-existing intellectual property, frameworks, tools, and methodologies. Clients receive a license to use these as part of their project deliverables.

    6.3 Third-Party Components

    Projects may include third-party libraries and components subject to their respective licenses. Clients are responsible for compliance with these licenses.

    7. Confidentiality

    Both parties agree to maintain the confidentiality of proprietary information shared during the course of the project. We will not disclose client information without permission, except as required by law.

    8. Warranties and Disclaimers

    8.1 Service Warranty

    We warrant that services will be performed in a professional and workmanlike manner. Specific warranties for deliverables will be outlined in project agreements.

    8.2 Disclaimer

    Services are provided "as is" except as specifically warranted in writing. We disclaim all other warranties, express or implied, including warranties of merchantability and fitness for a particular purpose.

    9. Limitation of Liability

    TekPiq's liability for any claim arising from our services shall not exceed the total amount paid by the client for the specific project or service giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages.

    10. Termination

    Either party may terminate a project agreement as specified in the project agreement. Upon termination, the client is responsible for payment for all work completed up to the termination date.

    11. Dispute Resolution

    Any disputes arising from these terms or our services shall first be attempted to be resolved through good-faith negotiations. If unsuccessful, disputes shall be resolved through binding arbitration in accordance with the laws of Bosnia and Herzegovina.

    12. Governing Law

    These Terms of Service shall be governed by and construed in accordance with the laws of Bosnia and Herzegovina, without regard to its conflict of law provisions.

    13. Changes to Terms

    We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Continued use of our services after changes constitutes acceptance of the modified terms.
